Drunk Hibachi Official Rules

NO PURCHASE NECESSARY.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  ALL ENTRIES MUST BE EARNED DURING THE ENTRY PERIOD.  VOID WHERE PROHIBITED BY LAW.

 

Eligibility:  

 

By downloading and playing Drunk Hibachi you agree to be bound by these Official Rules, the Opposite Lock Terms of Use and the Opposite Lock Privacy Policy.  These Official Rules are a legal binding agreement between You and Opposite Lock Entertainment LLC (“Opposite Lock”).  You agree that you have read understand, accept and agree to be bound by these Official Rules.  If you do not agree to these Official Rules do not play Drunk Hibachi.  

 

Prize offerings are open only to legal residents of the fifty (50) United States, D.C., Canada (excluding Quebec), and the United Kingdom who are eighteen (18) years of age or older as of date of entry. void where prohibited. All prize offerings in any opposite lock games are governed exclusively by the laws of the state of Connecticut with regard to conflicts of law.

 

Prize offerings are not open to employees, officers or directors --or to members of the immediate family or household of any of the foregoing-- of Opposite Lock Entertainment, LLC, or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved now or in the future. Each prize offering is subject to all applicable laws

 

Entry Period:

Opposite Lock’s database computer/server is the official time-keeping device for each prize offering. In the event of any discrepancy between these Official Rules and the in-game posted specific information or prize details for any particular prize offering, the terms of these Official Rules will govern.

 

How to Enter:

 

Players can win fictitious digital ‘Drunk Hibachi Raffle Tickets’ by playing the cooking game and earning virtual money from virtual customers. When earning a ‘Drunk Hibachi Raffle Ticket’ it enters that ticket into the drawing. Each ticket is linked to player’s unique ID number (‘Player Tag’). The game is programmed to randomly select a ‘ticket’ for each of the available in-game digital prizes being offered for each tier of that particular in-game drawing. Each drawing has a limited number of prizes being offered (available to win). All prizes for any active offering are clearly detailed in-game in the “PRIZES” section.

Prizes:

 

All prize details are at Opposite Lock’s sole discretion. The actual details of prizes included will be determined by Opposite Lock in its sole discretion. Prizes to be awarded "as is" and any and all warranties and/or guarantees (if any) shall be subject to the prize manufacturer’s terms; therefore, winners agree to look solely to such manufacturer(s) for any such warranty(s) and/or guarantee(s), if any. Any prize depiction is for illustrative purposes only and shall not be relied upon. Prizes are not transferable or redeemable for cash. No substitutions of prizes by winners are allowed, but Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion.

 

Judging Methods:

 

One (1) winner (per available prize) from the eligible players will be selected by Opposite Lock as detailed in these Official Rules.  Odds of winning depend upon the number of entries received.

 

Drawing and Winner Notification:

 

Eligible players who win a prize offering are sent notification to their in-game message ‘inbox’. Eligible winning players may be asked to ‘CONFIRM’ or ‘CLAIM’ the prize before and/or after verification. Opposite Lock will take 24-48 hours on average to process the prize award. This processing will include verifying all prize winners in a best effort to ensure eligibility and root out any possible cheating, hacking or unauthorized manipulations of any sort. Once processing and verification is complete, Gift Card codes will be sent to the winning player’s inbox. Winning players may be required to ‘CLAIM’ prize (by tapping ‘CLAIM’ button) in a set and reasonably sufficient amount of time or else the prize ‘expires’. The Prize is non-transferable.  Opposite Lock is not responsible for Prize utility or otherwise.  The Prize may be considered income, and any and all taxes associated with a Prize are the responsibility of the winner.

 

No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within the set, reasonably sufficient time allotted after the first notification attempt, or if the prize notification is returned as unclaimed or undeliverable to such potential winner for any other reason, such potential winner may be disqualified and an alternate winner may be selected.

 

If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.

 

Taxes and Fees:

 

Winners are responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize. All taxes, fees and surcharges on prizes are the sole responsibility of the game winners. Opposite Lock, by law, may be required to withhold certain taxes or other assessments with respect to the prizes awarded in any Opposite Lock game and reserves the right to withhold any such applicable taxes with respect to such prizes.

 

Current IRS regulations require Opposite Lock to send 1099 Forms to all U.S. citizens who win more than $600 in any calendar year. Opposite Lock will send the forms within the first 45 days of the new year. The IRS also requires the reporting of any transaction involving more than $10,000. To comply with these regulations, Opposite Lock may require winners to provide us with their social security numbers prior to the release of their winnings.

Non-U.S. residents are subject to United States tax withheld from winnings and are responsible for any local taxes. We must withhold the IRS foreign withholding tax for all non-U.S. winners, no matter the amount won, based on IRS regulations.

 

Grant of License/Publicity:

 

Except where prohibited by law, by playing Drunk Hibachi or by winning a prize, players grant to Opposite Lock the right to publicize the entrant’s name, photograph, image, likeness, voice, statements, and biographical information in all manner and media, worldwide, in perpetuity, for advertising, trade, and promotion purposes without compensation and without opportunity for review.  Ownership of the underlying intellectual property shall remain with the player.  Except where prohibited by law, by playing Drunk Hibachi, players grant to Opposite Lock a royalty-free, limited, non-exclusive license to use, reproduce, reprint, publish, distribute, display, exploit and use entries and the photograph of the player in any and all media now known or devised, worldwide, in perpetuity and without compensation, permission or notification to player or any third party.  

 

LIMITATION OF LIABILITY:

 

OPPOSITE LOCK, ITS EMPLOYEES, AGENTS AND REPRESENTATIVES, OFFICERS AND OFFICIALS AND THEIR IMMEDIATE FAMILIES, SUCCESSORS AND ASSIGNS, AND ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF DRUNK HIBACHI SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR (I) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PLAYERS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE GAME; (II) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, MALFUNCTIONS, INTERRUPTIONS OR DISCONNECTIONS IN TELEPHONE OR NETWORK HARDWARE OR SOFTWARE; (III) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE GAME; (IV) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE GAME; OR (V) FAILED, INCOMPLETE, GARBLED, JUMBLED, CORRUPTED OR DELAYED COMPUTER TRANSMISSIONS WHICH MAY LIMIT AN INDIVIDUAL’S ABILITY TO DOWNLOAD ANY MATERIALS RELATED TO DRUNK HIBACHI INCLUDING ANY INJURY OR DAMAGE TO PLAYER’S OR ANY OTHER PERSON’S COMPUTER OR MOBILE DEVICE.

 

RELEASE:

 

EACH PLAYER AGREES, EXCEPT WHERE PROHIBITED BY LAW, TO RELEASE AND DISCHARGE, HOLD HARMLESS AND INDEMNIFY OPPOSITE LOCK, ITS EMPLOYEES, AGENTS AND REPRESENTATIVES, OFFICERS AND OFFICIALS AND THEIR IMMEDIATE FAMILIES SUCCESSORS AND ASSIGNS, AND ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF DRUNK HIBACHI, FROM:  ANY AND ALL TAX LIABILITY THAT MAY BE IMPOSED OR ASSOCIATED WITH RECEIPT OR USE OF THE PRIZE; AND FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS, AND LIABILITY FOR ANY DAMAGES, EXPENSES, FEES, INJURY OR LOSSES SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, USE OR MISUSE OF THE PRIZE OR WHILE PREPARING FOR OR PARTICIPATING IN DRUNK HIBACHI OR RELATED ACTIVITY; AND FROM ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS, AND LIABILITY FOR ANY DAMAGES, EXPENSES, FEES, INJURY OR LOSSES SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP, USE OR MISUSE OF THE SUBMISSION MATERIALS OR PHOTOGRAPHS.

 

Disqualification:

 

Opposite Lock reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of any Opposite Lock game or Prize Offering, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of any Opposite Lock game or Prize Offering, or to annoy, abuse, threaten or harass any other person, and Opposite Lock reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.

 

Miscellaneous Provisions:

 

In the event of a dispute as to the identity of an entrant, the entry will be deemed submitted by the authorized account holder (‘player tag’ ID) submitted with the entry, provided such account holder must still meet the eligibility requirements for the prize offering. The authorized account holder shall be the natural person to whom the applicable Player Tag has been assigned.

 

Opposite Lock reserves the right to modify, extend, suspend, or terminate any prize offering, in whole or in part, if it determines, in its sole discretion, that the prize offering is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the prize offering as contemplated herein.

 

Only the type and quantity of prizes described in the particular game will be awarded in that game’s prize offering. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of such number of prizes, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question will be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant's sole and exclusive remedy in such circumstances.

Maximum award limit of 1 gift card claim per year.
 

LIST OF WINNERS: To obtain a list of winners of prizes with a value of $100 or more, send an e-mail to support@oppositelockgames.com with the subject line reading “Winner’s List Request.” All requests for a list of winners must include the specific game title and date range of prize offering (ET time zone).
